July 12 まじなメモ 「おおスザンナ」とアメリカの copyright

 　前のメモがタイトルからズレテいることに気づいたのでマジで( ..)φメモ。

　　前の記事で引用した英語版Wikipedia (q.v. "copyright")の "History"  には第一段落で "Charles II of England was concerned by the unregulated copying of books and passed the Licensing Act of 1662 by Act of Parliament, which established a register of licensed books and required a copy to be deposited with the Stationers Company, essentially continuing the licensing of material that had long been in effect." という文がありました（下線追加）。英国には今日も "copyright (deposit) library" と呼ばれる制度というか図書館があり、『リーダーズ英和辞典』の説明を借りれば「《英》納本図書館《英国内で出版されたすべての本１部の紀壮を受ける権利を有する図書館；British Library など》」とあります。上の引用中の "Stationers" は文房具屋じゃなくて出版業者の意味ですが、出版した本を出版者とともに届け出て実物を預け入れる(deposit) という制度が起こったことを言っているようです。

　　で、英和辞典で引いてもよくわからなかったdeposit の意味合いがこういうのを読んでいてわかったように思いました。１９世紀中葉のアメリカでも現物をもっていってそれをdeposit　してcopyrightを取るという手続きがあったのだと。

　　現在アメリカ合衆国のcopyright を扱っている機関は その名も "the United State Copyright Office" といって、Library of Congress の中に存在しています。それで、Library of Congress の資料がcopyright のdeposit の期日を手書きで書きこんだcopyが多いことの説明がつきます。もっとも、これは1897年にできたものだそうで、またWikipedia の、今度は "United States Copyright Office" の説明をちょっとだけ借りるとこうです。――

The United States Constitution gives Congress the power to enact laws establishing a system of copyright in the United States, and the first federal copyright law was enacted in May 1790 (with the first work being registered within two weeks). Originally, claims were recorded by Clerks of U.S. district courts. In 1870, copyright functions were centralized in the Library of Congress under the direction of the then Librarian of Congress Ainsworth Rand Spofford. The Copyright Office became a separate department of the Library of Congress in 1897, and Thorvald Solberg was appointed the first Register of Copyrights.[1]

　　もとは "Clerks of U.S. district courts" が記録していたというのです（これは「おおスザンナ」のいろいろなヴァージョンの版の表紙で目にした通りです。それが1870年にLibrary of Congress が一括集中的に扱うようになった云々とのことです。

　　そして、現在のU.S. Copyright Office のHPを見ると、"mandatory deposit" という項目があって、簡単な要約だと、

Mandatory Deposit in Brief

• All works under copyright protection that are published in the United States are subject to the mandatory deposit provision of the copyright law.

• This law requires that two copies of the best edition of every copyrightable work published in the United States be sent to the Copyright Office within 3 months of publication.

要するに、合衆国内で刊行されたコピーライトに相当する作物の最良の版２部を刊行後３カ月以内にCopyright Office に送れ、それが著作権法上義務となっているdeposit (まだ訳せませんがいちおう「預入」）義務規定だと。これはつまり前の記事で書いた著作権の「方式主義」の「登録」に伴う義務であると考えられるわけです。で、ここで問題になっているのは（あるいは１９世紀半ばに問題になっていたのは）、著者〈作者）が誰か、ということではなかったろう、ということなわけです。
