July 16 まむしドリンク リサイクルとCRV（つづき） California Redemptive/Refund Value

   やっぱちゃんと法律を読んで正しい知識と理解をもたねばならん、と AB2020 "Recycling and Litter Reduction Act" 通称 California Bottle Act から調べようとしましたが、その後の改定が加わったヴァージョンしかなく、疲れたので国のEnvironmental Protection Agency というところの解説も参照したらさらに疲れました。1987年に述べられた目標は 80% Recycling Rate （80%リサイクル率）。そしてReduce Litter　（ゴミの散乱の削減）、Increase landfill diversion （ごみ埋め立て地の増大） というようなものですかね。

　　　カリフォルニア州の制度が他の州のと違っていたのは、第一に小売店にはdeposit を集めて消費者にrefund を還元する責任が必ずしもないこと、第二にやはり小売店は、買われた容器の返却収集を引き受ける必要が必ずしもないことですか。年収200万ドル未満の店舗は使用したビンカンを引き取る義務はないそうです。それより大きな店舗も、半径0.5マイル以内にリサイクル・センターがあれば免除。リサイクルセンターがない地域では、小売店業者たちがリサイクル業者と契約して回収リサイクルセンターや"reverse vending machine" （ふつうは金を入れて飲み物容器が出てくるのが自販機ですが、逆に容器を入れて金が出てくる逆自販機）を設置する。上のEnvironmental Protection Agency の報告(?)はメーカーが州のリサイクル基金に容器一つにつき2セント支払い、容器が返却されると州の基金は2.5セントをその容器を収集した個人や団体に支払う（その差額は消費者リサイクルのincentive）みたいに書いてあるのだけれど、そして今年にupdate されているページなのだけれど、どういうことなのでしょう。こういうふうにいろいろ読むといろいろわからないつまずきが出てくるのが人生というものですね。

　　　下の"Notes" のところに "California Redemption Value is paid when a beverage container is purchased.  California Refund Value is received when a beverage container is returned for recycling.  CRV is used to reference both terms."  と書かれています。同様の文言を他のポスターにも発見しました。「California Redemption Value は飲料容器を購入する際に支払われます。California Refund Value は飲料容器がリサイクルに戻されたときに受け取るものです。CRV は両方を指すのに用いられます。」　あ、なるほどね～♪　

　　　ただ、上の条例の文書では実は "California Refund Value"のほうが出てこないことにモーリちゃんの父は気づいています。Chapter 5 "Minimum Redemption Value" の14560.5.の(c) の(2) に　"(2) For purposes of paragraph (1), the redemption payment shall be identified by one of the following descriptive terms: “California Redemption Value,” “CA Redemption Value,” “CRV,” “California Cash Refund,” “CA Cash Refund,” or any other message specified in Section 14561." と書かれています。(1)　というのは飲料品の商品は個別にredemption payment を明示すること、という文言の書かれた段落です。そのためにいくつかの表記が並べられている箇所です。そしてSection 14561 というのは次の一節です。そしてこの14560と14561でしかCRVという略語は出てきません。

14561. (a) A beverage manufacturer shall clearly indicate on all beverage containers sold or offered for sale by that beverage manufacturer in this state the message "CA Redemption Value," "California Redemption Value," "CA Cash Refund," "California Cash Refund," or "CA CRV,” by either printing or embossing the beverage container or by securely affixing a clear and prominent stamp, label, or other device to the beverage container.

　　モーリちゃんの父が飲むモノでちょろちょろ見たところ、こないだ買ったギネスの缶には "CA REDEMPTION VALUE" と缶の上に刻まれていました。もっともCA はRedemption Value の上にあって、VT とかNY とかと同様に州の略称として使われているので、CRV を一部write out したという意味にはならないかもしれませんが。でもカリフォルニア州が定めた表記のなかには "refund" という言葉は確かにあっても、redemption value のように value とつながってフレーズになっているものはないのでした。

　　もしかすると後知恵なのかも。もしかするとそのうちやっぱり CRV = California Recycle Value とか言い出すかも（しつこいで笑）　　

　　　さて、当初は、飲料容器関係だと、炭酸飲料だけだったのが、2000年に、果汁、水、無炭酸飲料も加わった。でもワインと蒸留酒は引き続き対象外です（このあいだの記事の引用の中にビールと並んで「モルト」とあったのはビール以外のモルト材料飲料ですね）。その2001年1月1日に運用された"Recycling and Litter Reduction Act" のカヴァーする品物のリスト（2008年6月24日アップデート版）が資料としてpdf. でネットに載っています。― "Sample Products Covered under the Beverage Container Recycling and Litter Reduction Act Starting January 1, 2001: Effective January 1, 2001; Updated June, 24, 2008"

The following is a list of products for which the Department of Conservation’s Division of Recycling has made determinations regarding inclusion in the Beverage Container Recycling Act effective January 1, 2001. This list is not all-inclusive, and as additional beverages are brought to our attention they will be added to the list. Exclusions are milk, infant formula, distilled spirits, wine, medical foods, 100% fruit juice in 46 oz. or larger containers, vegetable juice in containers above 16 ounces, and beverages in large size containers that are refillable. If you have questions regarding the status of a particular beverage that is not on this list, call 1-800-RECYCLE and the operator will put you in touch with staff that can provide you with guidance in making the appropriate determination. Upon determination we will add products to this list.

　　 そうして、アルファベット順で品目があがっているのですが、一番にあがっている飲み物にはずっこけました。――
